A CNS News reporter asks Nancy Pelosi an extremely pertinent question: What part of the Constitution gives Congress the power to require that Americans purchase something? The obvious answer is that no part of the Constitution gives Congress that power.  Meaning that Congress doesn’t have that power.  Meaning that any federal law with such a requirement would be unconstitutional by definition. Which is why Pelosi chooses to bluster her way past the question instead of answering it.

The intensity is ratcheting ever higher as we move toward the final stages of the health care fight. It’s been a good week for reformers overall. Pelosi and Reid are both whipping for strong bills, including a very strong public option (in the House) or a respectable public option (in the Senate). Progress is being made on other key components of the package including the affordability issue.

So, I’m searching google for a nice picture of Rep. Bachmann for this post, and finding lots of leftist unflattering and even offensive photo-shopped pictures of the successful woman. And I’m thinking, well yeah, same could be found for Nancy Pelosi and even Obama … But the fact is very little if anything needs done to ’shop’ unflattering pictures of liberal women, as opposed to the lengths the left has to go to in order to make conservative women look ‘bad’. Just an observation.

Nancy Pelosi might not know the Constitutional basis for health care reform but when it comes to passing out the freebies our government knows no bounds. There’s something almost adorable about the way some people with a limited grasp of our nation’s constitution attempt to lean on, twist and otherwise molest the document in an attempt to support their own world view. The latest incident came after a reporter asked Nancy Pelosi where the Constitution empowered Congress to enact an individual health insurance mandate. Her response, calling the question itself “ridiculous,” has brought one of the old legal bogeymen back into the public eye.

Ed Morrissey of Hot Air has pumped out an essay defending the rightwing’s largely unsuccessful effort to convince any reputable constitutional law scholar (on the right or left) that proposed healthcare reform would violate the Constitution. Morrissey’s essay takes issue with my recent post that applauds Nancy Pelosi for dismissing a CNSNews reporter’s question on the subject. Morrissey makes several arguments. I find none of them persuasive.

After writing several posts about the lack of constitutional authority of Congress to force Americans to buy health insurance or face fines and imprisonment, I assumed people understood the nature of the argument.  Kathy Kattenburg’s response to my post yesterday on the topic demonstrates that we need to make this a little more clear.  She links back to another blogger offering a strawman argument that appears to confuse Kathy:I am particularly perplexed/annoyed by the conservative assumption that unless explicit text directly authorizes a legislative enactment, then Congress necessarily lacks the power to pass the law.

I have had enough of Harry Reid and Nancy Pelosi blaming Republicans for not getting things done.
